Tenancy rights and conditions: Powys County Council

Mr X complained that Powys County Council failed to rectify a noise nuisance caused by his neighbour keeping too many dogs at their property, in breach of the tenancy agreement.

The Ombudsman decided that the response sent by the Council did not detail what actions it proposed to take to resolve the matter. She said this caused frustration and uncertainty to Mr X. She decided to settle the complaint without an investigation.

The Ombudsman sought and gained the Council’s agreement to issue a further response to Mr X within a week to advise of the actions it proposes to take to resolve the concern. Furthermore, it will arrange an appointment for a Housing Officer to attend Mr X’s home to assess and discuss his concerns further.
