Vale of Glamorgan Council
Mrs X complained that the Council had failed to determine her application for a definitive map modification order (“DMMO”) in accordance with a direction issued by Planning Environment Decisions Wales (“PEDW”). She also complained that the Council had failed to respond to communications sent to it, in which she expressed her concerns about the situation.
The Ombudsman found that the Council had failed to comply with the direction issued by PEDW and that it had not provided Mrs X with confirmation as to when her application would be processed. She also found that the Council had failed to respond to 2emails sent to it by Mrs X, in which she expressed her concerns about the situation.
The Ombudsman contacted the Council and in resolution of Mrs X’s complaint, it agreed to:
Within 10 working days:
• Provide her with a written apology for the failure to determine her DMMO application in accordance with the timescale specified by PEDW.
• Provide her with a written apology and explanation for the failure to respond to her 2 emails expressing concern.
• Provide her with written confirmation that her DMMO application would be reported to, and determined by, the Public Rights of Way Committee meeting due to be held in January 2023. If the Committee was unable to deliver a decision verbally, the Council would notify her of the decision within 5 working days following the meeting.
